Merlin de Douai. Ce nom évoque d’abord la fameuse loi des suspects (sept. 1793), l’un des textes organisant la Terreur ; il rappelle le parcours ambigu d’un patriote des Etats généraux devenu conventionnel régicide, thermidorien, ministre du Directoire, président du Directoire exécutif puis comte d’Empire ; il suggère enfin l’image du « prince des jurisconsultes », auteur admiré du Répertoire de jurisprudence et procureur général impérial à la Cour de cassation. De l’Ancien Régime à la Monarchie de Juillet, à la frontière du droit et de la politique, Merlin mena en effet une riche et étonnante carrière qui lui fit longtemps jouer un important rôle public. C’est l’itinéraire de ce juriste du temps des Révolutions, ses projets et son action politique ainsi que sa pensée juridique et sociale qu’Hervé Leuwers a tenté de reconstituer ici. L’auteur s’est également interrogé sur le parcours de toute une génération politique, dominée par des juristes comme Merlin, Cambacérès, Treilhard, Lanjuinais et Boissy d’Anglas, dont l’engagement révolutionnaire s’éteignit dans l’adhésion à l’Empire. Par l’étude d’un homme dont les discours et l’action ont contribué à l’émergence du citoyen, à l’unification proclamée de la nation, à la réforme du droit et de la justice, à la laïcisation de l’Etat et de la société ou encore à la redéfinition des rapports entre les peuples, l’auteur a voulu approcher la lente et difficile élaboration d’une pensée et d’une pratique politiques d’avenir, dominées par les principes d’ordre et de liberté, ainsi que contribuer à l’étude de la montée d’une nouvelle catégorie d’hommes publics, les juristes, et plus particulièrement les avocats.
